Morac - Thanks.

As for the delay - yeah, you're posts keep getting flagged as spam by Akismet. The CAPTCHA is a first line of defense, and when I put that in place it REALLY cut down on the spam volume, but everything still goes through the standard WordPress Askismet anti-spam module. For some reason it always flags your posts for moderation and puts them in the queue and they don't show until I release them. Unfortunately it doesn't tell me exactly why they're flagged.

Someone posted a link to it over in the thread at TCM.
http://www.tvpredictions.com/tivostock013108.htm

There is now also TiVo's response to Dish's response at:
http://money.cnn.com/news/newsfeeds/articles/djf500/200801311612DOWJONESDJONLINE001027_FORTUNE5.htm

BTW is there some reason my posts take a long time to show up? I'm assuming it has something to do with a spam filter (Yahoo mail maybe?), but I thought that with the reCAPTCHA thing, my posts should show soon after I post them.

I tried to find a response on the EchoStar and DISH Network sites, but I didn't see anything - where did you find that? I'd like to cite it. Thanks!

Dish is not backing down:

"We are pleased the Federal Circuit found for us on Tivo’s hardware claims, but are disappointed in the Federal Circuit’s decision on the software claims. The decision, however, will have no effect on our current or future customers because EchoStar’s engineers have developed and deployed ‘next-generation’ DVR software to our customers’ DVRs. This improved software is fully operational, has been automatically downloaded to current customers, and does not infringe the Tivo patent at issue in the Federal Circuit’s ruling.

All DISH Network customers can continue to use their DVRs without any interruption or changes to the award-winning DVR features and services provided by DISH Network.

We intend to appeal the Federal Circuit’s ruling affirming the $94 million jury verdict.”
